Welcome to Smmall Cloud, a file sharing service provided by Smmall Inc. ("Smmall," "we," "our," or "us"). Please read these Terms of Service (the "Terms") carefully before using our file sharing site, Smmall Cloud (the "Service"). By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Use of Service
1.1. Prohibited Content
- You may not use Smmall Cloud to upload, store, or share content that is illegal, pornographic, or in violation of any applicable laws or regulations. Smmall reserves the right to monitor and remove content that violates this policy, and users who violate this policy may have their accounts terminated.
1.2. Bandwidth Limit
- Paid accounts are subject to a monthly bandwidth limit of 100GB. Exceeding this limit may result in a reduction in service quality or additional charges, as determined by Smmall.
2. User Accounts
2.1. Account Creation
- To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update this information to keep it accurate, current, and complete.
2.2. Account Security
- You are responsible for maintaining the security of your account and password. You agree not to disclose your password to any third party. You must immediately notify Smmall of any unauthorized use of your account or any other breach of security.
3. Intellectual Property
3.1. Ownership
- All intellectual property and proprietary rights in and to the Service, including all content, functionality, and design, are owned by Smmall or its licensors. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
4. Termination
Smmall reserves the right to terminate or suspend your account, with or without notice, for any violation of these Terms or any other behavior that we, in our sole discretion, determine to be harmful to other users or in violation of our policies.
5. Changes to the Service
Smmall reserves the right to modify or discontinue, temporarily or permanently, any part of the Service at our sole discretion. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
6. Disclaimer
The Service is provided "as is" and "as available." Smmall makes no warranties, either express or implied, regarding the Service, including but not limited to its accuracy, reliability, or fitness for a particular purpose.
7. Limitation of Liability
Smmall and its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages or any loss of profits or revenues, whether incurred directly or indirectly.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States of America and Tennessee, without regard to its conflict of laws principles.
